1. Service Description:
When a client uses Mystery Travel, a service provided by VacatioNation (an independent affiliate of Nexion Travel Group), the company offers semi-customized travel proposals based on the information provided by the client. 

Mystery Travel proposals include information on type of travel (including but not limiting to either cruise, air travel, tours, car trips), ages and number of travelers, budget (costs), trip insurance and travel dates. 

The destination remains a mystery until revealed via email, which happens within 3 business days from the time the client accepts the proposal for the trip, and provides authorization, payment method, and all necessary information for VacatioNation to finalize the reservation and bookings.

Although VacatioNation specializes in Mystery Travel, if surprise is not your thing, VacatioNation also offers fully customized trip bookings - you may visit the "About us" section of our webpages to inquire about those offerings, and understand the major suppliers we work with.

2. Client Responsibilities:
a. The client who fills out the Mystery Travel request form or a fully customized trip inquiry form must be at least 18 years-old and a legal resident of the United States.
b. VacatioNation will make every effort in curating trip experiences where there will be either reasonable time to obtain or minimal need for: required visas, documents and/or vaccination, based on the information provided by the client(s). However, clients are ultimately responsible for ensuring all travelers possess appropriate travel documentation, including visas, vaccinations, documents and passports.
c. The payor must be one of the guests included in the reservation.

3. Dispute Resolution:
In the event of a dispute, the client agrees to resolve the matter through arbitration and/or small claims court. The maximum settlement in case of litigation will not exceed $500.

4. Travel Insurance:
Clients are strongly advised to purchase travel insurance to safeguard against unforeseen circumstances such as trip cancellations, medical emergencies, or travel disruptions.

VacatioNation will include travel insurance on the proposal, which client may choose to decline assuming all risks.

5. Social Media and Promotions:
a. VacatioNation may use photos provided by the client for promotional and advertising purposes on social media platforms and other marketing materials.

b. By providing photos, the client agrees to release them to VacatioNation for promotional use.

c. If minors are depicted in provided photos, the client confirms obtaining necessary permissions for their appearance, ensures they are legally allowed to appear in promotional materials, and assumes full responsibility.

d. You retain all ownership rights to any photograph or other content, but by submitting or agreeing to our use of such content, you grant VacatioNation permission to use it as determined by us. By submitting content, including but not limited to photo captions, names of individuals appearing in the content, and your own name (collectively, “Content”), you grant us worldwide, unrestricted, royalty-free, irrevocable, sub-licensable rights to:
- Publish, publicly display and perform, modify, edit, alter, and otherwise use the Content in whole or in part, without further consent, review, or participation from you, for any purpose throughout the world, including commercial and promotional purposes, in any medium or format now existing or hereafter created.
- Use your name, commentary, and other information about you in connection with the Content.
e. We reserve the right to use, not use, or discontinue using any Content at our sole discretion at any time.
f. You must have permission to take photographs of individuals appearing in the content and their permission to have their image and name used by VacatioNation. If any individuals depicted are minors, you must obtain express permission from their parent or guardian. You represent and warrant that you have obtained permission from everyone who appears in the photograph (and their parent or guardian, if applicable) to be photographed and have the photograph and their names used and shared by VacatioNation in accordance with these Terms. Before obtaining their permission and sharing the photo with us, send them a copy of or a link to these Terms.
g. You agree not to submit any Content that:
- Infringes any intellectual property rights of any other person or third party, including but not limited to copyright and trademark.
- Defames or invades the privacy or publicity rights of any person, living or deceased, or infringes upon any person’s or third party’s personal, property, or other rights.
- Is inappropriate, sexually explicit, harassing, abusive, harmful, violent, or otherwise objectionable or offensive in any way.
- Contains any virus, worm, corrupt file, or other forms of malicious code or content that may harm a website or computer.
- Violates any law, statute, ordinance, or regulation.
h. All images, testimonials, and traveler photos shared on VacatioNation's social media channels, including but not limited to Facebook, Instagram, Twitter, Pinterest, TikTok, LinkedIn, and our blog, have been submitted by VacatioNation travelers who provided permission for their use. Trips presented vary in destination, budget, departure city, and travel dates, representing a wide range of VacatioNation experiences. Each VacatioNation trip is unique and depends on various factors (travel dates, budget, departure city, etc.). While all VacatioNation trips guarantee accommodations and travel, additional activities are not guaranteed. Therefore, your trip may differ from those shown on social media.

6. Booking and Payment:
a. Once the client accepts the Mystery Trip proposal and provides payment information for booking, it is understood that the booking is final and nonrefundable, even if passengers do not ultimately take the trip.

Customizable trips (non-Mystery Travel) services provided by VacatioNation may be refundable according to the supplier's terms and conditions at the time of reservation. 

b. The client acknowledges and agrees that the provided payment method is their own or that they have obtained permission to use such payment method.

c. The payor must be one of the guests included in the reservation.

7. Reservation Guarantees and Additional Items:
a. VacatioNation only guarantees the reservation for items specifically included in the proposal. Meals, parking fees and/or internet may not be included and are responsibility of the client. Sometimes, hotels and resorts charge additional daily fees which may not be included in the price paid by client when reservation is made and those fees are the client's responsibility upon checking into hotel or resort.

b. In the event that there is additional Mystery Travel budget remaining, VacatioNation reserves the right to add supplementary items such as a gift card, credits for optional trip elements, and/or tour items at its discretion.

8. Respectful Conduct:
VacatioNation maintains a strict policy of zero tolerance for disrespectful behavior towards any VacatioNation Travel Advisors and suppliers. We prioritize a positive and respectful environment for both our clients and employees. VacatioNation reserves the right to deny service to anyone who violates this policy.
Disrespectful behavior includes but is not limited to:
- Verbal or written abuse, including offensive language, threats, or harassment towards VacatioNation employees.
- Discriminatory remarks or actions based on race, gender, sexual orientation, religion, nationality, disability, or any other protected characteristic.
- Intentional disruption of VacatioNation's operations or services.
- Any behavior that creates a hostile or uncomfortable environment for VacatioNation employees or other clients.
- Any action that violates VacatioNation's policies or procedures.
VacatioNation reserves the right to interpret and enforce this policy at its discretion.

9. No Pets Policy:
Clients are not permitted to bring pets on VacatioNation trips. If client needs to take a service animal to the trip due to a disability, client is advised to contact VacatioNation via Travel@VacatioNation.net before accepting proposal so we can do our best to ensure a service animal can accompany the guest.

10. Health Disclaimer:
VacatioNation is not responsible for clients becoming sick during the trip, including but not limited to contagious illnesses such as COVID-19. Clients are responsible for their own health and well-being during the trip, including taking necessary precautions, vaccinations and following recommended disease prevention guidelines.

These terms and conditions constitute a legally binding agreement between you (the client) and VacatioNation. By using VacatioNation's services, you acknowledge that you have read, understood, and agree to abide by these terms and conditions in their entirety. VacatioNation reserves the right to update or modify these terms and conditions at any time without prior notice. It is your responsibility to review these terms periodically for changes. VacatioNation makes no representations or warranties of any kind, express or implied, regarding the accuracy, completeness, suitability, or reliability of the information provided. VacatioNation shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of its services. Furthermore, VacatioNation shall not be held responsible for any disputes, accidents, injuries, losses, or damages incurred during or as a result of using its services. By using VacatioNation's services, you agree to release VacatioNation from any and all liability associated with such incidents, including but not limited to illnesses such as COVID-19.
